Things are getting interesting in PA in terms of the legal challenge.

Apparently ballots that arrived on Tuesday, election day are included in the ballots that are being segregated. Ballots that arrived Tuesday through Today are being set aside. What we don't currently know is if those ballots have been counted or how many of them there are.

The Today Show just interviewed Senator Toomey (R-PA).

They asked him if why the votes are taking so long to count and if anything fishy is going on. As a lot of Americans believe something is up / fishy.

Toomey answered correctly. Nothing fishy is going on. This is all to be expected with PA not being able to count mail in ballots until polls closed on Tuesday. It takes time to count these ballots. When asked what about them all coming in in Biden's favor. He answered this is to be expected. Republicans voted in person on election day and democrats favored mail in ballots.

When asked if Trump has a path forward in PA he answered yes, a narrow on. We don't know where the ballots are from that are left to be counted. While the county Philly is heavily leans heavily to the left, areas of the county lean to the right. If the ballots come from that area of the county for the remaining counts, it might be enough to keep Trump in the lead.

Lastly they asked him about Trump's lawsuit. Does it have any legal standing.

Toomey's answer was absolutely. This is the one lawsuit with legal merritt filed by Trump that will likely work in his favor. Toomey says the PA Supreme court went rouge. They do not have the power to change election law. What they did is completely illegal and unconstitutional. First, they didn't have the powder to change the law, second saying ballots arriving after the election through Today, Friday, is completely illegal under the constitution. Ballots can not be cast after election day.

But don't other states like AZ and NC already have laws allowing votes to be counted received by a certate date if they were mailed by election day. Why aren't those laws illegal or have been challenged?

Even so, why would ballots received on Election Day itself be included in the ballots that could potentially be invalidated by the legal challenge? Why are those ballots being segregated along with the ballots received after election day.

It doesn't really make sense to me that anyone could make the argument that if you can't prove they were shipped on time then they don't count. Seems to me that you would have to prove they were shipped late. Otherwise it's kind of seems like saying that someone not having an alibi absent of all other evidence means they're guilty of murder.

That’s actually what the law says. I think it’s a valid point though. If the polls close on Tuesday and you’ve created a system that allows ballots to be received until Friday - you need to be able to reasonabley say they were in transit by tuesday.

the easy answer is to post mark/scan all mail.

the easier answer is to have one method for everyone.

It is inconceivable to the majority of Americans that would anyone would split a ticket. We are so divided as a people and in a bubble of our side to think it's possible for someone to split a ticket. And that a split ticket in itself is proof of something fishy going on.

There are a lot of people that can not understand the republicans saw in the house while at the same time Joe Biden won the vote for president from the same distract. To them this is proof something fishy is going on. Corruption, cheating and the election being stolen.

Even people on the left side of the aisle are finding this fishy. They however, are pointing there figure to the right saying something fishy happened that house seats went to Republicans where Joe Biden won the presidency.

But apparently there were a few million people who did split a ticket this election. Enough people to make it noticable. And the majority of our country can not wrap their head around that. It's not possible.

I usually vote a split ticket. I vote for candidates for a position, not for a party’s ideology. I would like to say that my straight ticket this year was a referendum on the republicans backing the president, but it’s really because I voted for those candidates.

I often vote republican for treasury and court positions. I was a supporter of Elizabeth Dole here in NC because she was a good senator for our state.

I think the confusion is less about ticket splitting as an abstract concept, and more about what could possibly motivate it in this particular election.

I’ve said it before and I’ll say it again: the Republican Party declined to adopt any policy platform whatsoever this year. They offered nothing but liberal tears...

I usually vote a split ticket. I vote for candidates for a position, not for a party’s ideology. I would like to say that my straight ticket this year was a referendum in the republicans backing the president, but it’s really because I voted for those candidates.

...and there’s no reason, no reason at all, to think they’ll do anything different in 2022, 2024 or beyond. Those of you who are committed to a stance of majestic nonpartisanship, who wish for a world where making considered determinations about particular candidates rather than parties, need to be prepared for that.
