And if your unfilled order is outside the time limits for a chargeback, which vary but won't exceeed 3 months, you are probably wasting your time. And the creditor claim is virtually certain to be a waste of time for customers, who are the lowest form of creditors.
As an unsecured creditor that coincidentally filed a chargeback this past weekend (oh, the timing), with some work experience relating to the above, this is correct.

Hot take (and disclaimer I know nothing about US bankruptcy proceedings) but could this ABC thing be an attempt to shield the existing inventory from first lien creditors such that they can be distributed to customers under the new VLLLC structure... i.e. it's their attempt to ensure that customers DO get something back from their purchases... I can't imagine claims against a bankrupt shell company are going to yield results but if they've somehow saved enough cash to pay for shipping costs then continuing to service existing orders under the new liquidation company seems a sensible way of trying to get records out to customers... note I'm only talking about existing inventory, clearly no pre-orders are going to be fulfilled at this point... Also doesn't excuse them for continuing to take new orders/subscriptions which clearly they shouldn't be doing at this point!

this is not true. if it’s a preorder that has gone past the preorder date and VMP is not responding to your emails, many cards will still process chargebacks. People have even been reporting successful chargebacks on remainders of subscriptions given that VMP didnt mail them anything out last month.
