It's not survivable for the baby, and creates an increased risk of complications for the mother that include death. Their doctor urged her to get an abortion as soon as possible. The longer you wait, the higher the risks for complications and death.

Only, under Ohio State law, insurance is banned from paying for abortion unless the mother's life is in imminent danger. After spending $45,000 on fertility treatments, they didn't have the money to pay for the abortion and were unable to get it without help from insurance. This meant waiting week for the complications that put her life in imminent danger before she could get the abortion.


In what world does that make since or is proper healthcare. The baby already won't survive. We know there is an increased likelihood of complications that could cause death. Why don't we take care of it now rather than wait for the near death medical emergency that could have been easily prevented.

We live in a world where a small number of people with radical views and no real grasp of science are steering the ship. This is awful for this family and my heart goes out to this poor woman who is being traumatized.

Maryland has a little known law that is suddenly getting media attention after threatening to revoke a guys license.

Basically, in Maryland, if you have a condition that millions of Americans do called Sleep Apnea, you must report it to the DMV, fill out the required paperwork and have your doctor sign off that it is safe for you to drive. Failure to do so results in your license being suspended.

Last summer a guy went for a sleep study, when he knew could result in a sleep apnea diagnosis. He had to have the sleep study for something unrelated to sleep apnea, and of course a sleep apnea diagnosis came back. He never knew that in Maryland this could impact his ability to drive, and most have no idea that this is a Maryland law nor did his doctor.

In Maryland, after a sleep apnea diagnosis, you must get and complete the proper forms from the DMV, which include getting a sign off from your doctor that it is safe to drive. And of course, a diagnosis automatically gets reported to the DMV.

So fast forward to last month, and this guy gets a letter in the mail about his failure to comply with the law, and a notice that his license will be suspended in 15 days if the required forms are not completed and returned to the DMV.

And it turns out, for most sleep apnea diagnosis, this quickly escalates to threats of licenses being suspended and actual suspensions since this law was passed because nobody knows about it and what they need to do to keep their license.

I get that ignorance of the law is not an excuse. But I feel the state has a requirement to better inform people. This is just a cluster. And people are only getting informed now because the media is is running a story about the licenses suspensions.

Yeah there must be something shady as hell buried in the forms he signed before doing the sleep trial.

Diagnosis are automatically shared with the state's health department. This is a legal requirement and doesn't violate any laws as it is the law. It's for the states health official records and is shared federally as well I believe. It's not publically available nor provided to private companies.

However, in the case of the DMV, the health department now has a legal requirement under law to report sleep apnea diagnosis with the DMV, another government agency.

So, no laws are being broken, but rather followed as designed in this situation. What you think is confidential isn't truly confidential.
 
Law enforcement agencies are an excluded party in HIPAA. So not so much.
I guess that makes sense so schizophrenics can't own guns right? But the sleep apnea and DMV link has me confused. So the lack of sleep is a concern? Why aren't new parents on that list as well?

I'd argue that states have more ability to control and regulate driving laws and regulations than guns. We all known gun rights / 2nd amendment rights keep standing in the way, especially with conservatives and the current SCOTUS. While it makes more since with guns than sleep. Sleep is where they have the power.

And they have decided that lack of sleep is a safety issue.

I'd rather see them control guns and have red flag laws. But it is what it is. Things that make sense they can't do. Other things that don't, well they do because they can.
