It will most definitely be appealed.

I didn't think it could because it was dismissed.

A quick Google search tells me:

No it can't due to the law in place preventing defendants from being charged with the same crime twice. And only a defendant can appeal a criminal verdict, the state or federal government can't appeal a decision regarding a judge's decision to drop a case.

"For more than 18 months, Special Counsel Smith’s investigation and prosecution has been financed by substantial funds drawn from the Treasury without statutory authorization, and to try to rewrite history at this point seems near impossible,” Cannon wrote. “The Court has difficulty seeing how a remedy short of dismissal would cure this substantial separation-of-powers violation, but the answers are not entirely self-evident, and the caselaw is not well developed.

(Emphasis mine)

...not only is she obviously biased but she's also a complete fucking idiot — her inexperience and seeming reluctance to actually BE a judge has been a throughline for months now...

It will be appealed.

Has there ever been a more blatant display of judicial corruption in American history? This is Russian style justice.

Is Cannon so stupid to make her corruption so obvious, publishing this 'decision' when the Republican convention starts, and after the Saturday drama?

That was rhetorical, BTW.

It may make its way to the corrupt Supreme Court, where Cash Cow Clarence - becoming even more emboldened in displaying his corruption - gets another chance to weaken American democracy and rule of law.

from what i think i understand jack smith can still appeal the jury has to be seated and then dismissed for double jeopardy to apply.

It'll be appealed until just after Donald is back in office and immune/able to pardon himself. Cannon's not stupid she just doesn't care. She gets first dibs at a supreme court promotion from the guy she just got off, and both of them know there's nobody and nothing in the government willing or able to do anything about it. Experiment's over.

I guess what I don't get is - do these people not understand how history will view them?

It’ll be interesting to see what his speech is like tonight, given that he is rewriting it. Having a near death experience can change someone. I’m skeptical but willing to hear what he has to say (and there is still very little … as in no… chance he can get my vote). But it would certainly be nice to have a civil campaign, I don’t think I’ve ever witnessed one of those.

"The 93-page ruling from Cannon includes a dense legal discussion about the structure of the special counsel’s office, and why she thinks it doesn’t pass legal muster.

She only mentioned the allegations against Trump in the most cursory fashion, in a single paragraph, where she mentioned the specific crimes the former president was charged with."
