So the legislation being proposed to ban TikTok is more severe than folks realize. It is effectively a blank rule that allows the government to decide what technologies are a threat to national security, with zero insight into the process of how it is determined. Most fascinating and alarming to me is the penalties that can be imposed for violating this law should it pass:
(b) Civil Penalties.—The Secretary may impose the following civil penalties on a person for each violation by that person of this Act or any regulation, order, direction, mitigation measure, prohibition, or other authorization issued under this Act:

(1) A fine of not more than $250,000 or an amount that is twice the value of the transaction that is the basis of the violation with respect to which the penalty is imposed, whichever is greater.
(c) Criminal Penalties.—

(1) IN GENERAL.—A person who willfully commits, willfully attempts to commit, or willfully conspires to commit, or aids or abets in the commission of an unlawful act described in subsection (a) shall, upon conviction, be fined not more than $1,000,000, or if a natural person, may be imprisoned for not more than 20 years, or both.

This latter part sticks out, as friend notes, because though not explicitly defined, you could be in violation if you were to use a VPN to access TikTok.
…prison. For using TikTok…that’s where we are.

This is setting up for some pretty wild abuses by corporations in the future, as many dislike methods people use to avoid being track for legitimate activities.

Most ironic to me is the argument that this is intended to protect people’s personal data when the government does 💩 to hold US companies accountable for their own data breaches.
